TERMS AND CONDITIONS

  1. Validity of terms and conditions of sale

The terms and conditions of sale shall apply to the rights and obligations arising between the Customers of LAMPS4MAKEUP ‘s online store (hereafter referred to as Customer) and 1MLR OÜ/ LAMPS4MAKEUP  (hereafter referred to as LAMPS4MAKEUP) with the purchase of goods.

In addition to these terms and conditions, the legal relationships arising from the purchase of products from LAMPS4MAKEUP ‘s online store shall be regulated by the legislation applicable in the Republic of Estonia.

LAMPS4MAKEUP  shall reserve the right to change the terms and conditions of sale and the prices. These changes will be displayed on LAMPS4MAKEUP ‘s web page.

  1. Price information

All prices at LAMPS4MAKEUP ‘s online store include a value added tax of 20%.

  1. Placing an order

To order, find the items You wish to order and add them to your shopping cart. You can view the items in your shopping cart by clicking on the cart icon on the top of the web page.

You can change the quantity of items in Your shopping cart by writing the desired number in the appropriate field. If you want to delete the item from Your cart, click on the cross placed on the same line with the item.

Before proceeding with Your order, please choose the preferred delivery method.

To proceed with Your order, please click on “proceed to checkout“. Please fill in Your contact details in the required fields.

To confirm your order, click on “order and pay“. Next, a pro forma invoice will be generated and You can proceed immediately with a payment using your credit card, a bank link, paypal or by making a bank transfer. An order confirmation and a copy of Your invoice will be sent to Your email address.

Your order will be shipped after the receipt of payment.

  1. Entry into force of the contract of sale

The Customer undertakes to pay for the order after clicking „order and pay“.

The contract of sale shall enter into force after the receipt of the payment made by the Customer on the bank account of 1MLR  OÜ.

 

  1. Delivery

After the entry into force of the contract of sale (after the receipt of the payment made by the Customer), LAMPS4MAKEUP  will assemble the order and hands it over to the transport service provider for delivery.

In order to avoid delays in delivery, the order forms have to be filled in carefully and the delivery information submitted should be accurate and valid.

Products damaged (but not its packaging) during transportation shall be replaced to the Customer. Should the replacement be impossible, the Customer shall receive a refund equal to the price of the products.

LAMPS4MAKEUP shall not be held responsible for a delay in delivery if the goods were handed over to the transport service provider on time, but the delivery was delayed due to circumstances that LAMPS4MAKEUP  could not foresee or control.

Please always control Your delivery information (address, zip code, telephone number etc)!

Please notice that if You put company’s name in delivery information You will NOT receive any messages from DPD. This is a feature of DPD’s service. Thank You for understanding.

 

  1. Return policy

Items purchased through LAMPS4MAKEUP online store may be returned within 14 days of the date of the receipt. Should the Customer find the purchased item unsuitable, s/he can return it to the online store without indicating the cause for return.

To return purchased items, please contact our Customer Support and send it to info@lamps4makeup.com within 14 days of the date of the receipt of the goods.

The returned goods must be unused and its original package intact and undamaged.

Should it become inevitable that the Customer has to pay the return costs, the online store shall refund the cost of purchased items and return costs no later than within 14 days following the receipt of the request for withdrawal.

The withdrawal period of 14 days shall not apply to the following items:

  1. items produced taking into account the Customer’s specific needs;
  2. items produced custom-made according to conditions set out by the Customer;
  3. items mixed or diluted with some other product or items, so that they can no longer be separated from each other;
  4. items used for business and professional activity purposes;
  5. breakdown or failure resulting from improper use of the appliance (failure to follow instructions for use);
  6. appliance that had been plugged in wrong voltage;
  7. broken items or items with mechanical damage (e.g. after falling);
  8. damage as a result of normal wear and tear or in the event of faults which do not cause the appliance’s depreciation of value nor impair its use;
  9. the appliance has undergone repairs by a technician/repair center not authorized by the manufacturer.

If the Customer does not receive the items he had ordered, or the items delivered do not correspond to the description provided on the web page, or items appear defective, the

Customer may, instead of filing a request for withdrawal within 14 days of receipt, use his/her right arising from the law to submit a complaint.

  1. The use of the purchased items/goods for business or professional activity purposes (incl. legal persons)

In the event where purchased items have been used for business or professional activity purposes or have been purchased by a legal person, the ordinary complaints procedure shall not apply. In these cases, the period for filing a complaint is usually 6 months or more – depending on the time limits set by the manufacturer. During this period, if the manufacturer’s defect had been detected, the item will be replaced or will undergo a repair.

The items shall not be subject to retun if:

  1. items produced taking into account the Customer’s specific needs;
  2. items are produced custom-made according to conditions set out by the Customer;
  3. items are mixed or diluted with some other product or items, so that they can no longer be separated from each other;
  4. breakdown or failure resulting from improper use of the appliance (failure to follow instructions for use);
  5. appliance was plugged in wrong voltage;
  6. items have mechanical damage or are broken (e.g. after falling);
  7. damage as a result of normal wear and tear or in the event of faults which do not cause the appliance’s depreciation of value nor impair its use;
  8. the appliance has undergone repairs by a technician/repair center not authorized by the manufacturer.
  1. Liability

Should LAMPS4MAKEUP or the Customer breach the present terms and cause damage to the other party, the breaching party shall be liable to the non-breaching party in the events and to the extent provided for in the legislation of the Republic of Estonia.

  1. Force majeure

LAMPS4MAKEUP shall not be held liable for the damage caused or for delivery delays, if the damage or delay is caused due to circumstances LAMPS4MAKEUP could not foresee or control.

  1. Processing of personal data

The information and personal data collected when visiting LAMPS4MAKEUP online store and during the processing of orders shall be treated as confidential and shall not be disclosed to third parties.

Encrypted communication with banks during the payment of goods ensures the security of the Customer’s personal bank details.

The online store only uses the personal data entered by the Customer (including name, phone, number, address, e-mail and bank details) for processing the order and sending goods to the Customer. The online store forwards personal data to the transport service provider in order to deliver goods.

The online store sends newsletters and offers to the Customer’s e-mail address only if the Customer has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail.

The Customer is able to opt out of offers and newsletters sent to their e-mail address at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.

  1. Complaints procedure

LAMPS4MAKEUP is responsible for the non-compliance of goods sold to the Customer with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the goods to the Customer.

The Customer has the right to turn to the online store within two months of the occurrence of a defect by emailing to info@lamps4makeup.com

The complaint should contain the following information:

  1. Customer’s name and contact details;
  2. Date of presenting a complaint;
  3. Description of the product’s defects;
  4. Complaint being presented to LAMPS4MAKEUP;
  5. Reference to documents, confirming the fact of the transaction or a warranty, or provide their copies in the attachment.

LAMPS4MAKEUP will reply to a complaint in writing within 15 days as of the receipt of the complaint from the Customer. If LAMPS4MAKEUP is unable to provide a response to the Customer’s complaint within 15 days, LAMPS4MAKEUP will inform the Customer of that in writing, stating the reason for delay and the date by which the response will be provided.

LAMPS4MAKEUP shall not assume liability for defects that have resulted through the Consumer’s fault, either due to improper storage or non-intended use of products. Defects are product defects, not defects of packaging.

Should the goods appear to be non-compliant to the contract’s terms and conditions, or have defects or malfunctions, the Customer shall have the right to demand the repair or replacement of the goods. If the repair or replacement is impossible, or proves unsuccessful, or causes the Customer unreasonable inconvenience, the Customer shall retain the right to withdraw from the contract and claim the return of money.

If the Customer and LAMPS4MAKEUP are not able to settle the dispute by agreement, the Customer may contact the Consumer Dispute Committee.

You can review the procedural rules and submit a complaint here. Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the Online

Store. Resolution of disputes by the Consumer Dispute Committee is free of charge for the purchaser.

 

The Customer may also turn to the dispute resolution bodies of the European Union.
